Your Rights as a California Resident
This notice to California residents is provided under California law. It is intended to supplement NewAge’s Privacy Policy. Under California law, certain California residents may have rights regarding their personal information as described below, subject to certain exceptions.
If you make a request and we believe that you are subject to California law, NewAge will respond within forty-five (45) days, unless it is necessary to extend our response time.
Notice of Data Collection
We collect the following categories of personal information when you interact with us: identifiers/contact information, business information, geolocation data, and inferences drawn from the data collection. This information is collected to provide our services to your business. A more detailed description of the categories of data and the legal purpose for collection of that data is located in our Privacy Policy under “Use of Your Information” section of NewAge’s Privacy Policy.
California Resident Rights
Right to Deletion
You may have the right to request that NewAge delete any of your personal information we collect and retain about you. To enforce this right, you need to submit a valid and verifiable request. NewAge will then verify your identity and/or authority to make the request and thereafter determine if retaining the information is necessary for NewAge or our service providers or contractors to:
- Complete a transaction for which we collected the personal information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
- Help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate to those purposes;
- Debug products to identify and repair errors that impair existing intended functionality;
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when deletion of the information may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; and/or
- Comply with a legal obligation.
If none of the above retention conditions apply, NewAge will delete your personal information from our records and direct our service providers to do the same.
Right to Correction
You have the right to request that NewAge correct inaccurate personal information which we maintain about you. To enforce this right, you need to submit a valid and verifiable request. NewAge will then verify your identity and/or authority to make the request. If verified, NewAge will use commercially reasonable efforts to correct inaccurate personal information, as directed.
Right to Know
You have the right to request that NewAge disclose certain information regarding our business practices with respect to personal information. To enforce this right, you need to submit a valid and verifiable request. NewAge will then verify your identity and/or authority to make the request. If verified, NewAge will disclose to you any of the following at your direction:
- The categories of personal information we have collected or shared about you.
- The categories of sources for the personal information we have collected about you.
- Our business or commercial purpose for collecting or sharing that personal information.
- The categories of third-parties to whom we disclose or with whom we share that personal information by category or categories of personal information for each category of third-parties to whom the personal information was shared.
- The specific pieces of personal information we collected about you.
- If NewAge disclosed your personal information to a third-party for a business purpose, a list of the personal information types each recipient received and the category of third-party type to whom it was disclosed.
Right to Opt-Out
California residents have the right to direct a business that sells or shares your personal information to third-parties not to sell or share your personal information. This right is referred to as “the right to opt-out.” To enforce this right, you need to submit a valid and verifiable request. NewAge will then verify your identity and/or authority to make the request. If verified, NewAge will cease sharing your personal data. Because NewAge does not sell personal data for monetary compensation or other valuable consideration, we do not provide an opt-out for these activities. NewAge does share data for the purposes of targeted advertising; therefore, we provide you with the option to opt-out of such processing for these purposes. To do so, select the “Right to Opt-Out (Do Not Sell or Share Personal Information)” request type option from the menu when completing the data privacy request webform.
Right to Limit Use and Disclosure
California residents have the right, at any time, to inquire about and limit the use of your sensitive personal information. NewAge does not collect any sensitive personal information under California law.
How to Make a Privacy Request
Making Access and Deletion Requests
To make a request pursuant to any of the above-referenced rights including access or deletion, please email info@newageindustries.com. In order to complete a request, NewAge may need to verify your identity. We will send you a link to verify your email address and may request additional documentation or information solely for the purpose of verifying your identity.
Shine the Light Act
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain members of NewAge to third-parties for the third-parties’ direct marketing purposes. Pursuant to California Civil Code Section 1798.83(c)(2), NewAge does not share our customers’ information with other organizations for third-parties’ direct marketing use unless a customer elects that we do so.
